Description
of Service
1.1
3WestTv.com is a
broadcast portal catering to artists, producers and their fans. This is subject to the terms and conditions of
use for 3WestTv.com’s website (Hereafter referred to as “site”.)
1.2
It may also be
subject to other proprietary notices and copyright information found on this
website, the terms of which must also be observed and followed.
1.3
By submitting or
posting any information, videos, comments, opinions, statements, services,
offers, data, files, links, ideas, software, images or any other form of
content or information (altogether referred to as content) you acknowledge and
agree to the terms and conditions outlined below.
2.
Monthly
Subscription ’s
2.1
At no time before,
during or after will the Monthly Subscription of $9.95 (CDN) fee is not and
never will be considered a financial investment in 3WestTv.com or any partner,
affiliate and or heirs.
2.2
The $9.95 Monthly
Subscription per member is divided as follows and not subject to change without
consent of the majority of Monthly Subscribers.

30% of the fee
(After PayPal deductions) used to help offset the operating costs of the
3WestTv.com Website and operations

30% of the fee (After
PayPal deductions) used to advertise and promote Artists (3WestTv.com has and
will have only one advertising campaign “Ever Heard of “Artist Name” Probably
Not – www.3WestTv.com)
·
30% of the fee
(After PayPal deductions) put into an Artist Development and Studio Operations Fund so Artists can
create their art without having to save up for a long time to go into a studio
·
The Remainder is
donated to an internationally recognized Charity of the Monthly Subscribers
Choice., based on a voting with the majority consensus (Where a majority is
defined as 71% or higher) 3WestTv.com
will try to match the Subscription or even double it if funds are available.
2.3
3WestTv will from
month to month endeavor to find within reasonable financial means a
non-monetary form of compensation for the Paid Monthly Subscribers that may or
may not take the form of compilation CD’s, direct input into content
development, special (sneak previews) or other features not available to the
general membership and or public.
3.
Cancellation
3.1
The Artists, and
Basic Free Members (hereafter referred to as members) can cancel the agreement
at any time.
3.2
Monthly
Subscription members are required to
give us 30 days notice so that we can effectively cancel your PayPal
subscription
4.
Refunds of
Monthly Subscription s
4.1
Due to the nature
of the how the funds are dispersed refunds are not available at any time.
5.
Registration
5.1
All members must
register through the 3WestTv.com website.
5.2
The members will
create a username and password.
5.3
Members understand
that it is their responsibility to safeguard their account.
5.4
The members are
fully responsible for all activities that occurred while using their
account.
5.5
Members agree to
immediately notify 3WestTv.com of any unauthorized use.
6.
On-Demand
Video (On-Demand Video)
6.1
3WestTv.com provides an On-Demand Video service to video and musical
artists.
6.2
Royalties are subject to the Media Producers Collective Agreement
6.3
3WestTv.com is not liable to Royalties owed to anyone other than the
licensed copyright holder or their authorized representative that placed the
on-demand video on the 3WestTv.com site. And subject to The Media Producers
Collective Agreement and or licensing agency.
6.4
Members acknowledge that they do not have the right to download and share
the On-demand videos and all copyright must be respected. Failure to do so may result in the offending
member being barred from the site and possible legal action taken to recover
lost income for the copyright owner of the material in question.
7.
Broadcast
Seasons (Streaming Video)
7.1
3WestTv.com has
two broadcast seasons.
7.2
Winter / Spring
Season (Jan – June).
7.3
Summer / Fall
Season (July – Dec).
7.4
Programs run for
26 weeks with a minimum of 26 30-min (22-min broadcast) episodes. Then take the following season off. Unless the program is a continual program
(I.E. News, Entertainment, Soap Operas etc).
9.
Audio
Broadcasts
9.1
3WestTv.com operates an 24/7 audio streaming broadcast
9.2
At no time will 3WestTv make available individual songs for download
9.3
Audio Artist members have a right to place their copyrighted material for
free download on the 3WestTv.com site.
9.4
Audio Artist members may be required to provide proof of ownership
9.5
In the case of cover tunes (I.E.
Other Copyrighted Material) The Audio Member must provide licensed
reproduction, performance and broadcast
rights
9.6
Royalties are subject to ASCAP licensing guidelines.
9.7
In the event that the artist’s rights are not covered by ASCAP, then
royalties may be payable under The Media Producers Collective Agreement.
